About the book - The role of traditional courts in the justice system: Acting within the provisions of the Constitution
This book serves to highlight the role or function of traditional courts (in the administration of justice), which is to ensure not only access to justice to all citizens but also to create a traditional court system that is transparent, observing the rule of law and in line with the constitutional values and fundamental human rights.
To do this effectively, traditional courts must not only undergo the oversight of these two courts: magistrate's court and high court but also identify customary practices which are still in conflict with certain provisions.
The book offers practical insight into how those customary practices can be transformed so they not only conform to constitutional values, human rights and the rule of law but also fall in line with their own traditional style of living as opposed to observing the Western style of living.
In summary, this book not only delves into how transformation of the customary law can be achieved but it also highlights the need for training of the Traditional courts judicial officers and provides a clear framework of how it should be done.
